Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to face alien smuggling allegations, he was held in federal custody.

In her order, the court pointed out that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal proceedings center on conflicting assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in the state of Tennessee.

The court, who was overseeing his petition to removal in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
